Tila Tequila, of Myspace fame, is making claims that her album, the "Sex EP" is in fact, not her and is urging fans and retailers everywhere to not buy into the hype. The album is a "fake".
The album was allegedly recorded by Tequila after signing an agreement for a 7-song EP to be released through an indie label, The Saturday Team. The label then inked a distribution deal for the EP with Icon Music Entertainment.
Directly following the distribution deal, Tila Tequila began to speak out, beginning on Myspace, that the album was a "fake" and that The Saturday Team are trying to "steal money" from her fans by using her name. She has gone so far as to threaten legal action against online retailers if they sell the "Sex EP".
The Saturday Team has now filed a lawsuit against Tila Tequila claiming breach of contract, and amongst other complaints, demanding all negative comments about the label be removed from Myspace and be retracted.
Tila Tequila had some success with her iTunes exclusive single, "I Love U", produced by Lil' Jon. It had a decent showing of #84 on the Itunes digital charts.
While Helen Yu does not represent Tila Tequila, even though she would like to, if she were advising her, these are the three things she would say:
1) Make absolutely sure there was no written agreement between her and the record label.
2) Obtain all records such as recording studio logs, and in the future, make sure to sign in and out of the recording studio logs each and every time there to show you were or were not there.
3) In addition to filing a false declaration of origin, she would bring a claim for appropriation of her likeness, i.e. using her image to make money.
